In response, China's Interim Measures for the Management of Generative Artificial Intelligence Services (2023) mandate that providers implement safeguards to prevent overuse and addiction, especially for users under 18. These measures include technical controls such as time limits, content moderation, and age verification mechanisms. While these requirements aim to protect vulnerable populations, their effectiveness may be limited by challenges in verifying user age, the sophistication of circumvention tactics, and the balance between user autonomy and paternalism. Additionally, there is an ongoing debate about the definition and measurement of "addiction" in the context of digital services, complicating enforcement and compliance efforts. As generative AI becomes more integrated into daily life, the need for robust, adaptable protections for minors continues to grow, requiring ongoing regulatory attention and cross-sector collaboration.

Governance Context

China's regulatory framework for generative AI explicitly requires service providers to prevent excessive use and addiction, particularly among minors. Article 9 of the Interim Measures mandates providers to take effective measures, such as setting time limits and providing warnings, to prevent addiction and protect minors' physical and mental health. The Cyberspace Administration of China (CAC) also requires age verification and real-name registration to ensure that safeguards are appropriately targeted. Providers must implement two concrete obligations: (1) establish technical controls such as daily usage caps and session timeouts for minors, and (2) deploy robust age verification systems to restrict access to protected features. Internationally, the EU's AI Act classifies AI systems intended for children as high-risk, requiring robust risk mitigation and transparency measures. Providers must implement controls such as parental consent mechanisms and regular risk assessments. Failing to comply can result in significant penalties, service suspension, or reputational damage. Additionally, regular compliance audits and reporting to authorities are often mandated.
